Under O.C.G.A. § 33-5-21, surplus line insurance may be procured from a nonadmitted insurer only through a licensed surplus line broker, only after an unsuccessful effort to obtain satisfactory coverage from authorized insurers, and, for residential dwelling coverage, only if the coverage cannot be obtained from an authorized insurer. A producer holding only a P&C agent license cannot place the risk directly; the placement must go through a Surplus Lines Broker, who must use an insurer meeting the financial requirements of § 33-5-25 and remit Georgia's 4 percent surplus lines tax (§ 33-5-31).
