A Georgia insured carries 'reduction' UIM of 100/300 per person/per accident. The at-fault driver has a 50/100 liability policy that pays its full per-person limit. How much UIM is available to the insured per person after the setoff?
A$150,000
B$100,000
C$25,000
$50,000
Why this is the answer
Under the 'reduction' (setoff) election permitted by O.C.G.A. § 33-7-11, the per-person UIM limit is reduced dollar-for-dollar by the at-fault driver's available per-person liability coverage (the limit less anything already paid to other claimants). Here, $100,000 UIM minus the $50,000 per-person liability limit equals $50,000 of remaining UIM coverage. Total available compensation per person is $50,000 (BI) + $50,000 (UIM) = $100,000.
