Under R.C. 3937.18 as amended in 2001, which requirement applies to a named insured's rejection of UM/UIM coverage on an Ohio personal auto policy?
ARejection must be oral and witnessed by two adults
The named insured must reject UM/UIM in writing; the written rejection conclusively shows the offer was made and rejected
COhio policies must include UM/UIM equal to bodily injury liability limits because the named insured has no statutory right to reject the coverage in writing
DOnly insureds purchasing limits above 100/300 may reject UM/UIM
Why this is the answer
The 2001 amendments to R.C. 3937.18 require any rejection of UM/UIM coverage to be in writing. A signed rejection is conclusive evidence that the coverage was offered, explained, and declined, binding every insured under the policy. This replaced the more onerous Linko offer doctrine that had relied on a multi-prong test.
