Why this is the answer
211 CMR 79.04(13) bars any use of credit information from a consumer report in Massachusetts private passenger auto insurance, both in rating (classification plans, rules, rates, rating plans) and in underwriting (whether to issue or renew, or placement within an insurer group). Credit is therefore not merely limited but excluded; insurers may still use claims history, driving records and RMV reports.
