Maria is injured in a car accident on March 1. She first seeks medical treatment on March 16. Under §627.736, which PIP benefit outcome applies?

No PIP medical benefits are payable, because initial treatment came after 14 days
BPIP pays up to $10,000 for all covered medical expenses because she sought treatment within the calendar month
CPIP medical benefits are capped at $2,500 because treatment began after 14 days
DPIP pays the full $10,000 but only for emergency care after the 14-day mark

Why this is the answer

Under §627.736(1)(a), PIP medical benefits are payable only if the injured person receives initial services and care within 14 days after the motor vehicle accident. Maria's first treatment came 15 days after the accident, so PIP pays no medical benefits for this injury. The $2,500 figure belongs to a different rule: when initial care is timely, medical benefits reach $10,000 only if a physician, dentist, physician assistant or APRN determines the person had an emergency medical condition, and are limited to $2,500 if a provider determines there was none. The 14-day condition governs medical benefits only; disability benefits (60% of lost gross income) and the $5,000 death benefit are separate paragraphs of §627.736(1).
