Why this is the answer

TIC §1952.101(b) bars an insurer from issuing an auto liability policy in Texas unless the policy includes uninsured/underinsured motorist coverage, and §1952.101(c) lets any named insured reject that coverage in writing. So UM/UIM is built into the policy by default, not merely offered on request, and it can be waived only by a written rejection. Under §1952.105 the insured chooses the UM/UIM bodily injury and property damage limits, which may not exceed the policy's liability limits; the coverage must be at least the Chapter 601 minimums. Once a named insured rejects the coverage, the insurer need not add it back on a renewal or reinstatement unless the named insured asks for it in writing.
