Under Pennsylvania Act 6, if a named insured fails to make a written tort election on a new private passenger auto policy, which tort option applies by default?
Full Tort
BLimited Tort
CNo-Fault Only
DThe application is rejected until election is made
Why this is the answer
75 Pa.C.S. § 1705 requires every PA private passenger auto applicant to choose Limited Tort (cheaper, restricted right to sue for non-economic damages) or Full Tort (higher premium, unrestricted right to sue). If the applicant fails to return a signed election, the insurer must issue the policy under Full Tort.
