Under 215 ILCS 5/500-30(b), what background-check requirement applies to a first-time Illinois resident producer applicant?
ASelf-disclosure of any criminal history on the application form only
BReference letters from two licensed Illinois producers
CA signed affidavit from the applicant's appointing insurer that no felony exists
Submission of fingerprints to IDOI for state and FBI criminal history checks
Why this is the answer
215 ILCS 5/500-30(b) requires first-time Illinois resident producer applicants to submit fingerprints for state and federal criminal history checks. The Illinois State Police and FBI run the queries and report results to IDOI. The applicant pays the fingerprinting and processing fees. Self-disclosure on the application is also required, but fingerprinting is the verification mechanism. A felony conviction involving moral turpitude is grounds for denial under 215 ILCS 5/500-70(a)(6) without IDOI consent under federal law 18 U.S.C. 1033.
