Why this is the answer
NY Ins. Law § 5106(a) and 11 NYCRR § 65-3.8(a)(1) require a no-fault insurer to pay or deny a claim (in whole or in part) within 30 calendar days of receiving a properly completed proof of claim, including any reasonably requested verification. Overdue benefits accrue statutory interest of 2% per month and, if litigation or arbitration ensues, the claimant is entitled to attorney's fees under § 5106. The 30-day clock may be tolled by Reg 68 verification requests under § 65-3.5.
