An applicant for a California Personal Lines Broker-Agent license disclosed a 2019 misdemeanor petty-theft conviction (Penal Code § 484) on his application. Under Cal. Ins. Code § 1666, what is the role of the fingerprint submission in CDI's review?
AFingerprints are optional unless the applicant has disclosed a conviction; otherwise the application is reviewed solely on the basis of the self-disclosure
BFingerprints are required only when the applicant has resided outside California at any point during the prior twelve-month period
CFingerprints are required only for applicants over 21 years of age who are applying for life and accident-health lines
Fingerprints submitted via DOJ/FBI Live Scan are mandatory for all applicants and allow CDI to verify criminal history independent of self-disclosure
Why this is the answer
Cal. Ins. Code § 1666 directs the Commissioner to require fingerprints from every applicant for a producer license, which CDI implements through DOJ Live Scan plus FBI submission. This dual submission returns both California and federal RAP sheets, allowing CDI to verify (and frequently uncover) criminal history that self-disclosure missed. Failure to disclose a conviction that surfaces in the print return is itself a basis for denial under § 1668 (material misrepresentation in the application), separate from the underlying conduct.
