A Pennsylvania household insures three vehicles on one auto policy with $100,000 UIM per vehicle. The named insured did NOT sign any stacking waiver. What UIM limit is available for a single covered injury?
A$100,000 — stacking is prohibited
B$100,000 — stacking only applies across separate policies
C$0 — UIM was not separately purchased
$300,000 — stacked across the three vehicles
Why this is the answer
Section 1738 makes stacked UM/UIM the default in PA. Unless the named insured signs the statutory waiver, UM/UIM limits stack by the number of vehicles on the policy. Three vehicles at $100K UIM yields $300K available for one injured insured.
