Answering Without Advising
~10 min read · Point to the document or the lender — never interpret terms or give legal/loan advice.
The signing agent's hardest skill is answering forty borrower questions in an hour without once giving advice. The technique has a name — identify, locate, refer — and the exam tests whether you can sort 'what is this document?' (answerable) from 'is this rate good?' (never).
What you may do
A signing agent may identify each document and state its general purpose in factual terms ('this is the note — the written promise to repay; here are the amount and rate as printed'), may locate information within the package ('your payment figure is here on page 3 of the CD'), and may read aloud what the document says. The line: describing what a paper IS versus opining on what it MEANS FOR THIS BORROWER.

- Read: the printed words, without gloss
What you may never do
No explaining legal effect ('what happens to my heirs if…'), no characterizing loan terms ('that's a competitive rate'), no advising whether to sign, delay, or cancel, no interpreting prepayment, escrow, or default provisions, no title or vesting advice, and no drafting or altering language. UPL exposure is personal — 'the company told me to keep signings moving' defends nothing. Advice questions get the referral script: 'That's a question for your loan officer/attorney — let's call them now, or flag it for follow-up.'

- Referral is the answer, ideally live from the table
Handling the pause
When a borrower's question blocks progress: attempt the live call to the loan officer or escrow; if unreachable, offer the choice per instructions — continue and pursue the answer within the rescission window (where one exists), or stop and reschedule. A stopped signing handled by the book harms no one; an advised signing can harm everyone. Document what was asked and how it was routed.
Worked example
Rapid fire from a borrower: (1) 'What's this prepayment section actually cost me if I sell in two years?' (2) 'Where does it say my monthly payment?' (3) 'Would YOU take this rate?' (4) 'What IS an escrow account, just generally?' Sort and answer.
(2) is pure locate: turn to the CD's projected-payments table and point — fully within scope. (4) is borderline-safe identification: a general, textbook description ('an account the servicer uses to pay taxes and insurance from your monthly payment') states what the document provides without applying it — keep it generic and brief. (1) is interpretation of a provision's consequences for his situation: refer — 'let's get your loan officer on the phone for that one.' (3) is evaluation, the clearest violation of all: deflect cleanly — 'I'm a neutral party; I can't evaluate terms, but your loan officer can walk you through comparisons.' Two answered, two routed, zero advice — that distribution is the job.
Common exam pitfalls
Rewarding a friendly table with a 'personal opinion.'
Rate and term opinions are loan advice regardless of framing — neutrality is the entire professional identity.
Paraphrasing legal provisions to 'make them simple.'
Simplification is interpretation. Read the printed words or refer the question.
Believing employer instructions immunize UPL.
Unauthorized practice liability is personal — no signing service can authorize what the law forbids.
Name it, find it, read it — never weigh it, judge it, or choose it.
