Closing Disclosure & Rescission

Two consumer-protection documents anchor every signing agent's package knowledge: the Closing Disclosure with its three-business-day advance delivery, and the right of rescission with its three-business-day escape hatch. Same number, opposite directions — before signing and after.

The Closing Disclosure

The CD is the TRID-mandated five-page statement of final loan terms: loan amount, rate, payments, closing costs, cash to close. Federal law requires the borrower to receive it at least three business days before consummation — a lender/settlement-agent duty that is normally satisfied before the signing is even scheduled. The signing agent's role: identify the document, direct number questions to the lender's contact, and never recalculate or characterize the figures.

The right of rescission

For a refinance or home-equity loan secured by the borrower's principal dwelling, TILA grants three business days after signing to cancel. The Notice of Right to Cancel states the deadline date; each borrower (and in practice each person with an ownership interest) receives two copies. Not rescindable: purchase-money loans, investment properties, second homes. For rescission counting, business days include Saturdays but exclude Sundays and federal holidays — the notice's printed date controls, and an agent who spots a wrong date flags it to the lender rather than correcting it freehand.

The settlement statement

Alongside the CD, many packages carry an ALTA settlement statement — the escrow-side accounting of debits and credits for both parties. It is signed, occasionally acknowledged, and read carefully by borrowers hunting fees. Same discipline: identify, locate the figure asked about, refer interpretation to escrow or lender.

Worked example

A Tuesday-evening refinance signing on a primary residence. The borrower asks: (1) 'When can I actually cancel until?' and (2) 'This CD shows a $1,850 origination fee my loan officer said would be $900 — fix it or I won't sign.' Handle both.

(1) Factual: signing is Tuesday; count three business days — Wednesday, Thursday, Friday (Saturday counts as a business day for rescission when relevant; Sunday never) — the notice in the package states the exact deadline, typically midnight of the third business day: point to the printed date rather than improvising calendar math aloud. (2) The fee dispute is a loan-terms question: you cannot alter the CD, explain the fee, or promise anything — call the lender's closing contact together, or note the borrower's option to pause the signing. If they proceed, the rescission window is exactly the protection that lets them cancel after the lender answers. Document the interaction neutrally in your notes to the company. Scope held: dates read, disputes routed, nothing practiced as law.

Promising every borrower a cancellation right.

Recomputing the rescission deadline for the borrower.
