Affidavits in the Package

The affidavit cluster is where the signing agent's act-selection skill gets tested document by document: occupancy, identity, and compliance affidavits are sworn statements — jurats with oaths — while error-correction agreements are typically acknowledged. Read each certificate; administer what it says.

Occupancy affidavit

The borrower swears how the property will be used — primary residence (usually with a move-in-within-60-days undertaking), second home, or investment. Lenders price loans on occupancy, so lying here is mortgage fraud (fraud for housing). The document carries a jurat: the borrower signs before you and takes the oath. An agent who hears the borrower joke that 'we're actually renting it out' has a sworn-falsehood problem at the table — the oath cannot be administered to a statement the affiant admits is false.

Identity affidavits

The signature/name affidavit (AKA affidavit) lists the borrower's name variants — maiden names, middle-initial permutations, misspellings from the credit file — and the borrower swears (jurat) they are one person, signing a specimen of each variant. The same-name affidavit does the equivalent for a single alternate form. These protect chain-of-title matching; the notary's identification duty is unchanged — satisfactory evidence for the person, oath for the statement.

Compliance and correction agreements

The errors-and-omissions/compliance agreement commits the borrower to cooperate in re-executing or correcting documents with clerical defects post-closing. Depending on the form, it is acknowledged or sworn — the certificate printed on each document dictates the act. The signing agent performs exactly what each certificate calls for, never upgrading an acknowledgment to a jurat or downgrading a jurat to a stamp-and-go.

Worked example

Package contents: an occupancy affidavit (jurat), a signature affidavit listing four name variants (jurat), and a compliance agreement (acknowledgment). The borrower, mid-signing: 'Do I really have to swear? Just stamp them.' Execute all three correctly.

Occupancy affidavit: explain factually that this document requires an oath by its terms; the borrower signs in your presence, you administer the oath aloud, receive the audible yes, complete the jurat. Signature affidavit: same ceremony — plus the borrower signs each listed variant where indicated; one oath covers the one document's contents. Compliance agreement: the printed certificate is an acknowledgment — no oath, signature may pre-exist, borrower acknowledges execution. Journal: three entries (two jurats — oaths noted — one acknowledgment), fees per act, ID particulars each. Refusing to take the oath ends the jurat documents; 'just stamp it' is precisely the $750 violation of failing to administer a required oath.

Common exam pitfalls

Batch-stamping affidavits without oaths.

Each jurat requires its ceremony — signing in your presence plus an administered, answered oath. Skipping it is a penalty violation.

Choosing the act yourself when a certificate looks odd.

Perform what the printed certificate demands; route form defects to the lender — selection is their call, not yours.

Proceeding after the borrower disclaims the affidavit's truth.

You cannot administer an oath to an admitted falsehood — pause and elevate to the lender.

If it says sworn, they sign here and swear now; if it says acknowledged, they own the signature — the certificate is the script.
