EstatePass Platform Terms of Service

Welcome to the EstatePass platform, operated by EstatePass Inc. By accessing or using any of our apps and services — including EstatePass, MortgagePass, ContractorPass, and AppraiserPass — you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using any EstatePass platform app, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Description of Services

EstatePass Inc. provides online professional licensing exam preparation materials through the following apps and services:

  • EstatePass — Real estate licensing exam prep for all 50 US states
  • MortgagePass — NMLS SAFE MLO exam prep for mortgage loan originators
  • ContractorPass — Florida General Contractor license exam prep
  • AppraiserPass — Real estate appraiser certification exam prep

We also provide international exam preparation content covering Canada (RECO, BCFSA, RECA provincial licensing), Australia (Certificate IV in Property Services), and New Zealand (REA licensing).

Our apps and services include:

  • Practice questions and mock exams
  • Study materials and detailed explanations
  • Progress tracking and analytics
  • AI-powered tutoring assistance
  • Flashcards and study aids
  • Professional calculators and free tools

3. User Accounts

To access our services, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use

You are responsible for all activities that occur under your account.

4. Subscription and Payments

Auto-Renewable Subscriptions

EstatePass Inc. offers the following auto-renewable subscription plans via Apple In-App Purchase:

  • EstatePass Pro Monthly: $9.99 per month, includes a 3-day free trial for eligible users
  • EstatePass Pro Annual: $49.99 per year, includes a 7-day free trial for eligible users
  • MortgagePass Pro Monthly: $9.99 per month, includes a 3-day free trial for eligible users
  • MortgagePass Pro Annual: $49.99 per year, includes a 7-day free trial for eligible users
  • ContractorPass Pro Monthly: $9.99 per month, includes a 3-day free trial for eligible users
  • ContractorPass Pro Annual: $49.99 per year, includes a 7-day free trial for eligible users
  • AppraiserPass Pro Monthly: $9.99 per month, includes a 3-day free trial for eligible users
  • AppraiserPass Pro Annual: $49.99 per year, includes a 7-day free trial for eligible users

Payment and Billing

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Managing and Canceling Subscriptions

  • You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions.
  • Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until the end of the paid period.

Refunds

Refunds for App Store purchases are handled by Apple in accordance with Apple's refund policy. To request a refund, visit https://reportaproblem.apple.com or contact Apple Support.

Free Trial

If a free trial is offered, you will not be charged during the trial period. If you do not cancel before the free trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee. Free trial eligibility is determined by Apple and may be limited to one trial per Apple ID.

5. Account Deletion

You may delete your account at any time through any of our apps by navigating to Profile > Account > Delete Account. Since all EstatePass platform apps share the same account system, deleting your account will remove your data from all apps (EstatePass, MortgagePass, ContractorPass, and AppraiserPass). Upon account deletion:

  • All your personal data, including your profile, study progress, practice history, wrong answers, favorites, and AI session history, will be permanently deleted from our servers.
  • Your account will be signed out on all devices.
  • If you have an active subscription, account deletion does not automatically cancel your subscription. You must separately cancel your subscription through Settings > Apple ID > Subscriptions to avoid future charges.
  • Account deletion is permanent and cannot be undone.

6. Acceptable Use

You agree not to:

  • Share your account credentials with others
  • Copy, distribute, or sell our content
  • Use automated systems to access our services
  • Attempt to circumvent any security measures
  • Use our services for any illegal purpose
  • Harass, abuse, or harm other users

7. Intellectual Property

All content on all EstatePass platform apps — including EstatePass, MortgagePass, ContractorPass, and AppraiserPass — such as text, graphics, logos, and software, is owned by EstatePass Inc. or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, modify, or distribute our content without written permission.

8. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind. We do not guarantee that:

  • Our services will be uninterrupted or error-free
  • Our content is complete or up-to-date
  • You will pass your professional licensing exam

EstatePass, MortgagePass, ContractorPass, and AppraiserPass are study aids and do not replace official exam preparation materials or professional instruction. They are not affiliated with or endorsed by any state licensing authority, the NMLS, or any regulatory body.

9. Limitation of Liability

To the maximum extent permitted by law, EstatePass shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses.

10. Indemnification

You agree to indemnify and hold harmless EstatePass and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes by posting a notice on our website or sending an email. Continued use of our services after changes constitutes acceptance of the new terms.

12. Termination

We may terminate or suspend your account at any time for violation of these terms or for any other reason at our sole discretion. Upon termination, your right to use our services will immediately cease.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
