Why this is the answer
§ 3420(f)(1) is the mandatory UM statute. It requires every owner's policy issued or delivered in New York to include UM bodily injury coverage at limits equal to the third-party BI liability limits selected by the insured. If the insured buys 100/300 BI, UM is also 100/300 — the carrier may not issue UM at a lower 25/50 floor when BI is higher. UM cannot be rejected on a NY personal auto policy (unlike SUM, which is offered up to the BI limit and can be rejected). The 'equal-limits' rule is automatic and operates by force of statute.
