Under NY Ins. Law § 2112, when must an insurer file an appointment (certificate of appointment) for a NY-licensed agent?

ABefore the agent solicits any application on the insurer's behalf
BAnnually on January 1 for all appointed agents
Within 15 days from the date the agency contract is executed or the first application is submitted
DOnly when the agent earns more than $10,000 in commission from the insurer in a calendar year

Why this is the answer

NY Ins. Law § 2112 requires an insurer to file an electronic certificate of appointment with DFS within 15 days of executing an agency contract OR receiving the agent's first application, whichever is earlier. Brokers (§ 2104) generally do NOT require appointment — they represent the insured. Only AGENTS (§ 2103) require insurer appointment to bind the carrier and to receive commissions on the insurer's policies.
