Under N.J.S.A. 17:29A-15, what is New Jersey's general rate filing approach for most property and casualty lines other than private passenger auto?
APrior approval by DOBI before any rate may be used
BState-made rates set annually by the NJ Legislature for every P&C line
File-and-use, with DOBI retaining authority to disapprove
DNo filing of any kind required
Why this is the answer
For most property and casualty lines, New Jersey insurers file rates with DOBI and may begin using them upon filing, subject to the Commissioner's continuing authority to disapprove rates that are excessive, inadequate, or unfairly discriminatory. Private passenger auto is the principal exception and falls under prior approval. The Legislature does not set rates, and filings remain required.
