Under MCL 500.2250, before an insurer may deliver a property or casualty policy form in Michigan, the form generally must be:
AApproved by referendum of policyholders before any form may be delivered
BRegistered with the Michigan Secretary of State as a legal instrument
CPublished in the Michigan Register for 60 days prior to use
Filed with and not disapproved by the DIFS Director
Why this is the answer
Michigan uses a file-and-use form review under MCL 500.2250. Insurers submit policy forms to DIFS; the Director may disapprove forms that violate the Insurance Code, are misleading, or contain inequitable provisions. Use is permitted unless and until disapproved.
