Under 215 ILCS 5/403A, what is the maximum civil monetary penalty per violation that the IDOI Director may impose on an insurer (not a producer) for knowing violations of a cease and desist order?
AUp to $250 per violation, capped at $5,000 total
Up to $50,000 per knowing violation
COnly injunctive relief; no civil monetary penalty available
D$10,000, identical to the producer cap in 500-70
Why this is the answer
215 ILCS 5/403A authorizes the IDOI Director to impose civil monetary penalties of up to $50,000 per knowing violation of a cease and desist order against insurers and other regulated persons. This is the insurer-side counterpart to the $10,000 producer cap in 500-70. Injunctive relief is also available but is not the exclusive remedy, and the $250 figure has no statutory basis.
