An Illinois auto policy has been in force for 14 months. The insurer wishes to cancel mid-term for a reason other than non-payment. How many days written notice must the insurer give the named insured?
A10 days
B15 days
30 days
D60 days
Why this is the answer
Under 215 ILCS 5/143.19, after the first 60 days an Illinois personal auto policy may be cancelled mid-term only on specific statutory grounds — such as license suspension of an operator, fraud, or material misrepresentation. The insurer must mail written notice to the named insured at least 30 days before the effective cancellation date. Non-payment of premium requires only 10 days notice. The 60-day option does not apply mid-term.
