A New York pedestrian is struck by a hit-and-run vehicle that flees the scene; the pedestrian has no auto policy of her own and no resident relative with an auto policy. From which entity must she seek recovery for her bodily injuries?
Why this is the answer
The Motor Vehicle Accident Indemnification Corporation (MVAIC) is New York's residual safety net for victims of uninsured and hit-and-run motorists who have no UM coverage of their own or through a resident relative. It is funded by assessments on NY auto insurers and administers claims for qualified persons under Article 52 (§§ 5201-5213). A pedestrian without any household auto policy fits the classic MVAIC-eligible profile. PSIF is the NY guaranty fund for insolvent insurer claims; NYPIUA is the property FAIR Plan; NYAIP is the assigned risk plan that places drivers who cannot find voluntary auto coverage — none of these handle uninsured/hit-and-run BI claims.
