A California homeowner believes her insurer underpaid a fire claim. Under the CDI's consumer-services framework (Ins. Code § 12921.1), what is the FIRST formal step she can take with the Department?
File a written Request for Assistance (consumer complaint) with the CDI Consumer Services Division for review of the disputed payment
BFile a civil action in superior court because the CDI lacks any statutory authority to receive or investigate individual consumer complaints
CSubmit a formal APA rulemaking petition under Gov. Code § 11340.6 asking the Department to adopt a regulation against the insurer
DDemand binding arbitration directly with the insurer because consumer claim disputes fall entirely outside the CDI's jurisdiction
Why this is the answer
Ins. Code § 12921.1 requires the Commissioner to investigate written consumer complaints and report the disposition to the complainant. The mechanism is the Consumer Services Division's 'Request for Assistance' (RFA), filed online, by mail, or via the consumer hotline 800-927-4357. CDI forwards the complaint to the insurer, sets a response deadline (typically 21 days), reviews the insurer's reply, and may escalate to the Market Conduct Division if the complaint suggests a pattern of FCSPR violations. The RFA does not toll the policy's contractual suit-limitation period. See Ins. Code § 12921.1.
