Two separate permissions govern Part 107 operations, and this item checks whether you can tell which one a scenario triggers. §107.29 covers night operation and requires the aircraft to display anti-collision lighting visible for at least three statute miles; fly at night without it and you need a waiver of that section. §107.41 is unrelated to time of day — it requires prior ATC authorization to operate in Class B, C or D airspace, or within the lateral boundaries of the surface area of Class E designated for an airport. Because the scenario supplies no controlled-surface airspace of that kind, only the lighting deficiency creates a requirement. Operations over people would raise §107.39, which the scenario also rules out.
