Do Not Call Registry

Definition

The National Do Not Call Registry is a federal program administered by the FTC that allows consumers to opt out of receiving unsolicited telemarketing calls, including calls from real estate agents soliciting business.

Example

Agent Thompson wants to cold-call homeowners. Before making calls, Thompson must check both the National Do Not Call Registry and the brokerage's internal do-not-call list. If a homeowner sold through Thompson's brokerage six months ago, Thompson may call due to the established business relationship exemption.

Exam Tip

Exam questions focus on the exemptions and timeframes. Remember the two key exemptions: established business relationship (18 months from last transaction or 3 months from last inquiry) and prior written consent. Brokerages must maintain their own internal do-not-call lists in addition to the national registry.
