Express Agency

Definition

An agency relationship created by a clear, explicit agreement between the principal and agent, either orally or in writing.

Example

A seller signs a 6-month exclusive right-to-sell listing agreement with a broker. This written contract is an express agency agreement that clearly defines the terms, duties, and compensation.

Exam Tip

Express agency is created by AGREEMENT (written or oral). Most real estate agency is express. Compare with implied agency (created by conduct) and agency by estoppel (created by principal's misleading behavior).
