Do Not Call Registry

The National Do Not Call Registry is a federal program administered by the FTC that allows consumers to opt out of receiving unsolicited telemarketing calls, including calls from real estate agents soliciting business.

Understanding Do Not Call Registry

Real estate agents must comply with the Do Not Call Registry and TCPA when conducting telemarketing. Agents are prohibited from calling listed numbers unless they have an established business relationship or prior express written consent. An established business relationship exists if the consumer conducted a transaction within the past 18 months or made an inquiry within the past 3 months. Each brokerage must also maintain its own internal do-not-call list. Fines can exceed $50,000 per call.

Real-World Example

Agent Thompson wants to cold-call homeowners. Before making calls, Thompson must check both the National Do Not Call Registry and the brokerage's internal do-not-call list. If a homeowner sold through Thompson's brokerage six months ago, Thompson may call due to the established business relationship exemption.
